TIFAM Publication Policy on Images and Names in Events and Public Reporting

Purpose

This policy sets out the position of The Irish Field Archery Monthly (TIFAM) regarding the publication of photographs and names of individuals who participate in public and sporting events. This includes international and national competitions, cultural gatherings, Festivals and other open/public events, as well as archery shoots and events under recognised governing bodies, with due regard to their image and naming policies at both international and national levels.

1. Scope of the Policy

This Policy Applies To:

  • International Sporting and Cultural Events, including those with an archery context (shoots, competitions, festivals) sanctioned by recognised international federations and organisations.
  • National and Local Open and Public Events, including those with an archery context (shoots, competitions, festivals) sanctioned by recognised national federations, associations, interest groups, and any other applicable organisations.
  • Open and Public Gatherings, including competitions, shoots, demonstrations, and festivals, also with an archery context, where attendance and participation are visible to the public.

2. Legal Basis for Publication

a. Irish Law

  • Ireland does not recognise a separate “image right” or “right of publicity.”
  • Protection of image is derived only from privacy, data protection law (GDPR), and defamation law.
  • Irish courts have consistently recognised that individuals photographed at public events cannot reasonably expect privacy in that setting.
  • Article 40.6.1 of the Irish Constitution protects freedom of expression and explicitly recognises the role of the press.

b. European Human Rights Law

  • Article 10 of the European Convention on Human Rights (ECHR) guarantees freedom of expression, which includes the right of the press to publish images and names from public events.
  • Article 8 of the ECHR protects private life, but European Court of Human Rights rulings (Von Hannover v. Germany (2004, 2012); Axel Springer v. Germany (2012)) confirm that participants in public events hold a diminished expectation of privacy.

c. Data Protection (GDPR)

  • Photographs and names of identifiable individuals are considered personal data.

d. International Standards

  • UK courts: participants in public competitions hold limited privacy rights; press publication of event images requires no consent.
  • Canada: consent is not required when publication serves the public interest.
  • EU states (Germany, France, Poland, etc.): consistently uphold the balance between Article 8 and Article 10 in favour of press rights at public events.

3. Safeguards and Responsibilities

Minors:

  • Any image of a minor must be published with the consent of their legal guardian.
  • TIFAM avoids pairing full names with identifiable images of minors. First names or group identifiers may be used where editorially necessary.

Photographer Rights:

  • Copyright of photographs remains with the photographer.
  • TIFAM secures usage rights from the photographer before publication.

Editorial Ethics:

  • Images and names will be published only where they serve a legitimate journalistic purpose.
  • Coverage will always be respectful, accurate, and proportionate.
  • Publication is for reporting and documentary purposes, never for commercial exploitation of an individual’s likeness.

Transparency:

  • TIFAM makes this policy publicly available via its website.
  • Readers and participants are informed that images and names may appear in connection with event reporting.

4. Application to TIFAM

As a registered monthly magazine, TIFAM functions as part of the press and exercises the rights of journalistic reporting. Publication of images and names serves a legitimate journalistic and documentary purpose: to record, report, and celebrate public and sporting events at local, national, and international levels.


5. Conclusion

By participating in international, national, or local public events — including sporting competitions, cultural gatherings, and open/public shoots — individuals acknowledge that their image and name may form part of the documented record.

TIFAM, as a recognised press outlet, holds explicit rights under Irish, European, and international law to publish such material for journalistic purposes.
